YamaHost Terms & Conditions

1. Introduction

These Terms & Conditions ("Terms") govern your use of services provided by YamaHost.com ("YamaHost", "we", "us", or "our"). By accessing or using our services, you agree to be bound by these Terms. If you do not agree, please refrain from using our services.

2. Definitions

• Client: Any individual or entity that subscribes to or uses YamaHost's services.

• Services: All products and services offered by YamaHost, including but not limited to web hosting, domain registration, email services, and related support.

• Website: The YamaHost website located at www.yamahost.com.

3. Eligibility

To use our services, you must be at least 18 years old or have the legal capacity to enter into a binding contract.

4. Account Registration

Clients agree to provide accurate and complete information during the registration process and to keep such information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Service Provision

We strive to ensure continuous availability of our services but do not guarantee uninterrupted service. We reserve the right to modify or discontinue services at our discretion, with or without notice.

6. Free Trial Terms

We may offer free trials for certain services under the following conditions:

• Eligibility: Free trials are available to new clients only and are limited to one per individual or entity.

• Duration: The standard free trial period is 3 months unless specified otherwise.

• Restrictions: Free trials are not available to users registering with generic email services (e.g., Gmail, Yahoo, ProtonMail). Please use a professional business email address to request access.

• Automatic Conversion: Unless canceled before the end of the trial period, the service will automatically convert to a paid subscription, and applicable fees will be charged.

• Cancellation: You may cancel your free trial at any time before the trial period ends to avoid charges.

• Data Deletion: Upon cancellation or expiration of the free trial without conversion to a paid plan, all data associated with the trial account may be deleted.(TermsFeed)

7. Billing and Payment

• Fees: Clients agree to pay all fees associated with the services they subscribe to, as outlined on our website or in their service agreement.

• Payment Terms: Payments are due in advance of the service period. Failure to make timely payments may result in suspension or termination of services.

• Refunds: Refund policies, if any, are outlined on our website and are subject to change at our discretion.

8. Client Obligations

• Compliance: Clients agree to use our services in compliance with all applicable laws and regulations.

• Prohibited Activities: Clients shall not engage in activities that are illegal, infringe upon the rights of others, or interfere with the operation of our services.

• Security: Clients are responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.

9. Service Suspension and Termination

• Suspension: We reserve the right to suspend services for reasons including, but not limited to, non-payment, violation of these Terms, or activities that threaten the integrity of our services.

• Termination: Either party may terminate the service agreement with notice, subject to any contractual obligations. Upon termination, clients must cease using our services and may be required to pay any outstanding fees.

10. Limitation of Liability

To the maximum extent permitted by law, YamaHost shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with our services.

11. Indemnification

Clients agree to indemnify and hold harmless YamaHost, its affiliates, and employees from any claims, damages, or expenses arising from their use of our services or violation of these Terms.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on our website, and continued use of our services constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the South African courts.
